
A sessions court in Patna has granted interim protection from arrest to educator Khan Sir, also known as Faizal Khan, in a case linked to alleged firing by security personnel outside his coaching institute.
Pending consideration of his anticipatory bail petition, the court directed the investigation officer to produce the case diary and details of his criminal antecedents.
The order was passed on Tuesday by Sessions Judge Rupesh Deo in connection with Kadamkuan Police Station Case No. 418 of 2026, registered under Section 109 of the Bharatiya Nyaya Sanhita and Sections 25(9), 27 and 35 of the Arms Act.
According to the prosecution, police visited Khan GS Academy on June 4 while verifying a video circulating on social media. Two private security guards seen in the footage were traced, they were employed at the academy of the petitioner.
Further, the police contacted the petitioner, who is the Director of the said academy, and he confirmed that the individuals were security guards engaged through APS Security Agency located in Noida.
Later the security guards were produced before the police with their licensed rifles.
During questioning, the guards allegedly claimed that on the night of June 2, a group of persons gathered outside the academy and allegedly assaulted another security guard, thereby causing panic among students.
On hearing the matter, Khan Sir @ Faizal Khan and his staff came outside the academy and saw the crowd. It is alleged that the petitioner and an unidentified associate instructed the security guards to fire in order to disperse a crowd gathered outside the institute.
Subsequently, the security guards had fired two rounds each into the air.
The police alleged that the accused fired in a public place with the intention of causing panic and terror. Following the incident, both guards were arrested, their weapons were seized, and an FIR was lodged against them.
Besides these, against the petitioner and other unknown persons, legal proceedings were initiated as they were involved in instigating and facilitating the firing.
Appearing for the petitioner, counsel argued that the allegations against Khan Sir rested solely on the disclosure statements of the co-accused, which are inadmissible in evidence.
The counsel for the petitioner also submitted that he has been falsely implicated in the instant matter due to business rivalry with another coaching institute.
Regarding the charges of the Arms Act, it is specifically submitted that Section 25(9) of the Arms Act is bailable, and while Sections 27 and 35 are not attracted, as the firearms used were licensed.
It is also brought to the notice of the court that the petitioner cooperated with the investigation agency by calling the security guards, who appeared before the police with their licensed weapons.
Public Prosecutor, on the other hand, maintained that firearms licensed was obtained in 2012 in the backdrop of his father’s murder in the year 2011 for personal protection but had been put to improper use.
After hearing both the parties, the court granted interim relief to Khan Sir till the next date of hearing, June 20, and instructed him to cooperate with the Investigating Officer as and when required by the police authorities.
